Terms of Use

These Terms of Use ("Terms") are an agreement between you and Finav LLC, a California limited liability company ("Finav," "we," "us," or "our"). They govern your use of the Finav mobile application, finav.app, and related products and services (collectively, the "Service").

By creating an account, purchasing a subscription or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. You may use the Service only where permitted by applicable law.

What Finav Provides

Finav provides financial education, organizational tools and personalized guidance intended to help you understand your financial situation and consider possible next steps.

Finav is not a bank, lender, broker, investment adviser, financial planner, fiduciary, attorney, accountant or tax professional. The Service does not create an adviser-client or fiduciary relationship. Information provided through the Service is general educational information, not individualized investment, legal, tax or other licensed professional advice.

You remain responsible for your financial decisions. Consider consulting an appropriately qualified professional before making a significant decision.

AI-Generated Information

Portions of the Service use artificial intelligence to generate responses, summaries and suggestions. AI-generated information may be incomplete, inaccurate, outdated or unsuitable for your circumstances. Finav does not guarantee that an AI response is correct, complete or current.

You must independently verify important information, including amounts, deadlines, eligibility requirements, legal rights, tax consequences, product terms and information from third parties. Do not rely on the Service as the sole basis for a consequential financial decision.

Your Account

You must provide accurate information, protect your account credentials and promptly tell us about suspected unauthorized use. You are responsible for activity performed through your account unless applicable law provides otherwise.

Your Content

You retain your rights in messages, financial information and other content you submit to the Service. You grant Finav a limited, worldwide license to host, process, transmit, reproduce and create service-generated summaries from that content only as reasonably necessary to operate, personalize, secure and support the Service, comply with law and enforce these Terms.

You represent that you have the right to provide your content and that doing so does not violate another person's rights or applicable law.

Free Service and Guru Plus

Finav may provide both free features and a paid subscription called Guru Plus. The current features and usage limits included with each offering are shown in the app before purchase and may evolve as the Service improves.

At launch, Guru Plus is offered in the United States for $7.99 per month with no free trial. Localized pricing displayed by Apple or Google Play at the time of purchase controls. Guru Plus automatically renews for successive monthly periods until canceled.

Billing and renewal

Payment is charged to the Apple App Store or Google Play account you use to purchase Guru Plus. The applicable store processes the payment and renewal. To avoid a future renewal, cancel before the renewal date shown in your store subscription settings.

Price changes

We may change the price of a subscription. We will give you advance notice, and a new price applies only to renewal periods beginning after that notice. Where Apple or Google requires your consent to a price increase, your subscription will not renew at the higher price unless you agree; depending on the store, not responding may cause the subscription to stop renewing.

If you do not want to continue at a new price, cancel before the change takes effect. Cancelling is described below.

Cancellation

You can manage or cancel your subscription through the store where you purchased it:

• Manage Apple subscriptions
• Manage Google Play subscriptions

Unless applicable law or store rules provide otherwise, cancellation takes effect at the end of the current paid period and you retain Guru Plus access until then. If a subscription expires or payment fails, Guru Plus access may end and your account will return to the available free experience.

Refunds

Apple and Google generally control refunds for purchases processed through their stores. Refund availability is governed by the applicable store's rules and applicable law:

• Request an Apple refund
• Request a Google Play refund

Account Deletion and Subscriptions

You may request deletion through the app or our Delete Account page. Account deletion is subject to identity verification and a seven-day grace period, as described in our Privacy Policy.

Deleting your Finav account does not automatically cancel a subscription managed by Apple or Google Play. Cancel the subscription in the applicable store before deleting your account if you want to prevent renewal.

Acceptable Use

You may not:

• Use the Service unlawfully or to harm another person
• Attempt to gain unauthorized access to the Service, another account or related systems
• Disrupt, overload, probe or circumvent the Service or its safeguards
• Use automated means to scrape or access the Service except as we expressly permit
• Reverse engineer the Service except to the extent applicable law expressly permits
• Submit malicious code, deceptive content or content that violates another person's rights
• Use the Service to develop or train a competing model or service

Third-Party Services

The Service may connect to or link to third-party services, including Plaid, financial institutions, app stores and affiliate offers. Those services are governed by their own terms and privacy policies. Finav does not control their availability, content, pricing or practices.

Finav Intellectual Property

The Service, including its software, design, branding and content provided by Finav, is owned by Finav or its licensors and protected by intellectual-property law. Subject to these Terms, Finav grants you a limited, personal, nonexclusive, nontransferable and revocable right to use the Service for your own lawful purposes.

Availability, Suspension and Termination

We may modify, suspend or discontinue parts of the Service and may restrict or terminate access when reasonably necessary to protect the Service or others, respond to legal requirements, address nonpayment or enforce these Terms. Where practicable, we will provide notice.

You may stop using the Service at any time. Provisions that by their nature should survive termination will continue to apply, including ownership, disclaimers, liability limitations and dispute provisions.

Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." Finav disclaims warranties of merchantability, fitness for a particular purpose, title, noninfringement and any warranty arising from course of dealing or usage of trade.

We do not warrant that the Service will always be available, secure, error-free or accurate, or that use of the Service will produce a particular financial outcome.

Limitation of Liability

To the fullest extent permitted by law, Finav and its officers, directors, employees and agents will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, business interruption or financial losses arising from or related to the Service.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Finav harmless from third-party claims arising from your unlawful use of the Service, your content or your material violation of these Terms. This obligation does not apply where prohibited by consumer law.

Apple Standard EULA

For an application obtained through Apple's App Store, Apple's Standard End User License Agreement governs the license to the application. These Terms govern the Finav Service. If there is a conflict concerning the application license, Apple's Standard EULA controls.

Changes to These Terms

We may update these Terms to reflect changes to the Service or applicable requirements. We will post the updated Terms, change the date above and provide additional notice when required. If you do not agree to updated Terms, you must stop using the Service.

Governing Law

These Terms are governed by California law, without regard to conflict-of-law principles. This choice does not deprive you of non-waivable consumer protections available under the law where you live.
